Nintendo's rules are in contradiction to the law though. I have seen news stories get flagged for using clips of Nintendo's games. With their current settings, an Angry Review would definitely get flagged. A producer of a product being sold to the consumer having undue influence on the media produced about their product is anti-consumer. And yes, that includes taking revnue from reviewers, critics, pundits, and journalists as it impedes their ability to do their job. Plus, fair use doctrine clearly states that Nintendo has no right whatsoever to claim commentary, parody, review, etc., either pulling them down or taking a cut of the revenue. All products under those categories are the property of the creators alone; Nintendo has no rights whatsoever. |
Which law? Let's Play's have never been determined to fall under fair-use. The videos in question are let's plays/streams. If Nintendo is flagging reviews that is an entirely different story.
