To be fair, I don't think Nintendo has actually done that with an actual fan game. Mario 64 HD was only taken down because the original game was announced for Wii U's VC days later. They haven't taken down a multitude of fan projects like Ocarina of Time 2D, Mario 64 Star Road, Project M, etc. Plus, Iwata said himself that their properties can be used by fans for derivative works.
