GTA is different however since it is TRUE licensed music, as in the developer did not make the music in the radio channels and only got permission to include it in the game. Also, do Nintendo even sell their soundtracks separately? If not then once again I don't see what the issue is here. It's not like they're losing out on OST sales. I mean Destiny had one of the best soundtracks of all games last year to the point that they even sell the OST separately on itunes, but I don't see Bungie going out of their way to strike down videos with their music playing in the background of a level. It is part of the game's experience. Nintendo are just being needless archaic and harsh here when there's literally no reason to be.

Well, there have been many cases where GTA has been an issue but it won't be as much of an issue if the youtuber is part of some sort of a program with the publisher I believe that will exclude your channel from being hit with one. Nintendo also has a program like that but Joe is probably not part of it since he doesn't really do Nintendo very often and Nintendo is also more anal about it than most other western Publishers but also less than a few Japanese Publishers but it is their right which is the point I am trying to make since it is them that spent millions of dollars producing the game.

And Nintendo does but it depends on the game. Like, you can find various Nintendo OST's to buy such as Pokemon X&Y and Mario Kart wii and many other titles on itunes/amazon/etc. And they also have stuff for Club Nintendo members like SSB4 OST which is supposed to be exclusive songs btw but you can find them on youtube quite easily.
