The easiest way to work around that of course is to use royalty free music which various sites like youtube and twitch provide for freeeee for LPs. If they do that, than Nintendo as well as other companies will not monotize it at all.

By that logic every game has licensed music from the developer that made it. GTA is different however since it is TRUE licensed music, as in the developer did not make the music in the radio channels and only got permission to include it in the game. But even then I don't see any problems with people uploading and monetizing GTA videos.

Also, do Nintendo even sell their soundtracks separately? If not then once again I don't see what the issue is here. It's not like they're losing out on OST sales. I mean Destiny had one of the best soundtracks of all games last year to the point that they even sell the OST separately on itunes, but I don't see Bungie going out of their way to strike down videos with their music playing in the background of a level. It is part of the game's experience. Nintendo are just being needless archaic and harsh here when there's literally no reason to be.
