I doubt they would have let it slide if they didn't add those clones, which could have been poteintially newer and more excity character designs. Can't speak for Zelda, since I don't use her often, but I'm glad Samus and ZS Samus were seperated. I can actually use ZS competively now. So no complaints there.
I haven't been following Smash's ad complain too closely, but I imagine they'd still have grounds to call the cast larger even ignoring those 5 or 6 characters. Though really, since every game has had clones, I don't really see the need to complain about them adding a few more on this one at the last minute. I personally felt the new characters stood out a lot more in this game than Brawl. The existence of a couple clones doesn't change that.
