Microsoft is still allowing quite a bit of freedom regarding publishing and monetizing game footage. I think these policies are only in place so that Microsoft can let people publish things freely like Let's Plays, but MS still has control over the footage (for better or worse).
I don't think it's a big deal, and you shouldn't worry about it.
