No it would be like him using a move that should be illegal but there was an oversight and the rules havent been changed to disallow it yet. Thats why rules of sports are updated every so often, or for games we have patches.

Well, it's also up to the individual if they would do something like that. Just because there's a glitch, doesn't mean you should use it til it's fixed. Same thing with the eye poking.
