The 3DS is doing great. 2013 will just be its peak year, unless the New 3DS stirs things up next year in the rest of the world. People trying to compare the 3DS to the DS are setting themselves up for failure. The DS is the highest selling handheld of all time, so obviously anything that comes after will seem lackluster.
Considering the 3DS is now competing with the booming mobile market consisting of phones and tablets, it's doing extremely well for itself. In fact, it's doing on par with other Nintendo handhelds like the GameBoy. Just not the DS, clearly.
