Well... It won't really be a hardware contract though... All google has to do is give Nintendo the android api (which is open-source and essentially free anyway) and allow Nintendo to use their Play Store and make money off of that. When anyone makes a purchase from the Play Store, Google will get a royalty from it. And Nintendo can also have their eshop as well to have the exclusive Nintendo titles on there and not the Play Store (for obvious reasons)
