It doesn't really matter. Nintendo have total control over them, and the vast majority of the money they generate goes to Nintendo. They're functionally identical to a 1st party. At that point you may as well call them one, regardless to if you believe ownership is "all or nothing" (which is a silly notion, but i lack to energy to argue the point).
