Technically it happened last Gen, The Kinect version of the X360 can play titles which can't be played without Kinect, would imagine it caused a bit more annoyence considering that a few of the Games with Gold were Kinect titles so the free games offered to X360 owners couldn't be played without additional Hardware.
Sure you could go out and buy the hardware upgrade for your launch day 360 but original Kinect was 150euros and needed to play some games. This is more or less the same amount of money it'll cost you to go from 3ds > New 3ds if you make use of a trade in system of your older model 3DS.
