Buy ___ get one free promotions are temporarilly taking a hit on profit margins to move idle stock and/or encourage sales of items that are not on offer also.
However, you pick a 'free game' and are given a digital copy, you do not own a tangible, physical copy, and as no money has specifically changed hands for its aquisition, its a grey area.
if you take part in a buy___ get one free promotion in a store, youre leaving with a tangible, physical item, it cannot be revoked, removed or otherwise taken from you in any legal way once the transaction is complete.
As such, you buy mk8, the is a sale for mk8, you are then GIFTED the choice of a game.
To call the selected game a sale is like calling a prize won from a competition on a packet of pringles a sale, because you had to buy tge pringles to win it.
