Nintendo doesn't have a stake in the IP. That sits at the Pokemon Comapny, a company founded for the exact reason to manage the Pokemon IP. Nintendo has shares of this company. The situation is comparable to Monolith/Xenoblade. EDIT: This article explains it further: http://www.polygon.com/2014/6/19/5745732/what-is-the-pokemon-company "Founded in 1998 in Tokyo, Japan, the organization was established by Nintendo, Game Freak and Creatures — three companies independent from one another — as The Pokémon Center Company. It was officially named The Pokémon Company in 2000. |
If you can find me an article saying that Nintendo owns no part of the Pokemon franchise, not single part, I'll believe you. As of now, yes, the Pokemon Company has rights to Pokemon, but so does Nintendo and Game Freak. They all have a share in the IP.
