You're wrong. First sentence in the Wikipedia about Pokeon:

"Pokémon (ポケモン Pokemon?, /ˈpoʊkeɪmɒn/ POH-kay-mon[1][2]) is a media franchise published by Japanese video game company Nintendo, owned by The Pokémon Company"

http://en.wikipedia.org/wiki/Pokémon

The Poke,on Company is affiliated with Nintendo, like Intelligent System, GameFreak and Monolith.

I KNOW Nintendo owns Pokemon, where did I say they don't? I said they don't own Game Freak, for heaven's sake.

Read again what I wrote: The Pokemon IP isn't owned by Nintendo, but by another company named the Pokemon company. If I remember right, GameFreak and Nintendo have shares of this company. As you claim GameFreak isn't owned by Nintendo, then also  the Pokemon Company isn't owned by Nintendo and so they don't own the Pokemon IP.

Nintendo does not 100% own the IP, but the have a large stake in it. They had no stake in Xenoblade Chronicles, only in the company. Nintendo has direct control over a lot of the IP, with Game Freak focusing on developing and the Pokemon Company focusing on licensing.
