Other game companies buy the rights to use the cars in their games, in there contract they have the rights to destroy the cars. Phony Digital has received the rights to use the cars for free, with this contract they must keep the cars intact. Based on the fact that Phony Digital does not pay for the rights to destroy cars they must ask permission to do so.
Out of 700 cars there are lots of car companies that do not have their cars in any other game and may not allow there cars to be smashed, they may refuse to even sign a contract to allow their cars to be damaged even if Phony Digital offered to pay some cash.
It could also be that some companies do not care if there newer cars are smashed up, but old classics and concept cars maybe another story.
