The FCC will claim to do one thing while doing the exact opposite? No way! Couldn't be!
The FCC would determine on a case by case basis if the terms of preferential treatment negotiated by ISPs and content providers are “commercially reasonable.”
Meaning the harder you lobby them, the more leeway they'll give you. That should create a competitive market environment which will be great for consumers!
