It is published by Nintendo, but franchise and game is from another company that is not owned by Nintendo and Nintendo has exclusivity/publishing rights, the game is likely funded by Nintendo except that should not count as reason/argument against including it since a 3rd party game can be developed and published by 3rd party developer yet funded by company of that and that console... It is made by 3rd party developer and is 3rd party franchise thus it is a 3rd party game...
