no terms of anything near "we dont' have to provide content" and note the bold,... "sublicensed to you by Sony Computer Entertainment America". eshop is no different,. nintendo is the distributor. when you buy content on eshop you pay nintendo. when you recieve a refund on eshop it will come from nintendo.
don't base your argument on presumptions.
