because nintendo is the platform owner.
consumer purchases DLC on eshop => nintendo give money to publisher => publisher is paid.
..so logically, if a refund is to be distributed.
publisher gives money to nintendo => nintendo gives money to consumer => consumer is refunded.
what else could happen? it's not like WB was going to cut personal checks and mail them to peoples homes. at no point have you ever made a direct transaction with a 3rd party publisher. whether on eshop/psn/xbl or at brick and morter you are dealing with the distributor. this is absolutely no different than a store like target or best buy paying my refund when i choose to return a product created by company X, Y, or Z.
