Warner Bros. didn't give anybody a refund; at least, that's not how it appears. If I'm not mistaken, I believe most "season passes" usually come with a disclaimer noting that the publisher reserves the right to NOT supply the content the user is purchasing. Buying a season pass is entirely an act of faith.

Sounds like Warner Bros. kept the money and bailed, and Nintendo offered refunds to the (evidently very few) people who bought the season pass.

 

Nintendo runs the eShop so they have to be the ones to to credit to credit the money to your account. Warner doesn't have access to Nintendo's eShop records or the power to credit money to everyone's account so there is no way for them to do it themselves. There is no reason to assume that WB took the money and ran, you are just assuming that.

So where's the official statement from WB? How come Nintendo is the one who broke this news? No email from WB, no press release. They can go ahead and prove me wrong. Until then, Nintendo is taking the credit. So far, WB has nothing to say on the matter.

Like I said, I'm pretty sure WB is not obligated to supply the content OR a refund.
