I doubt any court would take them to task for being off by less than 10%. I'm sure you can fudge a little about your numbers without having to worry about litigation. Now if they had sold 1m and said 3m, then that would be a problem for them.

Yeah, and I don't see why people think that's impossible when they've done it before. Investors didn't rage back then, because they probably didn't even notice.

How do we know that Sony didn't fudge their numbers because they wanted to make the gap look more impressive?
