If I recall this case correctly, Tomita accussed Nintendo of stealing this tech when offering to use in 3DS development. During this period, numerous companies offered similarly technologies to Nintendo. I didn't really think Tomita had the strongest case though since at least one court sided with Nintendo I believe but i guess Tomita successfully appealed to another court
