Had their not been a specific law specifically banning something that couldn't of happened in the first place it probably would of never went to court.

This is partially true.  While some laws have existed for a long time, a lot of the state laws and state constitutional amendments against gay marraige were pushed through after the Massachusetts supreme court decision to allow it based on the Massachusetts constitution.  So a lot of states decided they had better get something into their constitutions so a similar court decision didn't happen in their state.
