The evidence that they are rushed ports is blatantly obvious; it's on a system with more than twice as much RAM, but they haven't even buffed the textures like Need for Speed and Trine 2 did. This exposes them red-handed as straight 360 ports without any effort made to utilise the system's advantages.

why would they waste there time on doing that when they are struggling to get it to run at an acceptable frame rate, cause of the hardware issues.

Hence laziness and lack of commitment. They could have improved textures and assets, but they didn't. In light of this, I'm not convinced the framerate issues are a hardware limitation given their demonstrated lack of effort.
