How can you happen to make a mistake like that?  Then the second game released in a row, Assassin's Creed Black Flag happens to also need a day one patch.  It's a huge coincidence, especially when it's been confirmed months ago that the PS4 version was running at 1080p already.

This conspiracy theory is confirmed as fact as soon as the Xbox One version of Asssassin's Creed 4 launches at 900p. 

And the only chance to avoid this new Microsoft rule is if you integrate some Kinect usage like in Battlefield or how did EA manage it?

I'm sure that is what a company like Ubisoft really wants, to troll Microsoft with a day one patch even with their agreement for resolution parity. Ubisoft and Activison can't imagine to do something better as to make a partner they need to sell millions of games angry.

Or do you think Microsoft said "game has to be 720p on disc but it's ok to patch it to 1080p on day one so that there is not really anythig which will change!"

I don't really see the advantage here? game is 1080p, if on disc or with the patch. What would Microsoft gain from that?
