There are. Square Enix was sued for advertising the Xbox360 version of FFXIII exclusively in the US but but used photoshoped footage of PS3 version in their commercials. They lost that suit and had to pay a hefty fine.

I could have sworn I read that there were fines that came along with them being forced to stop using the advertising.
