Rockstar probably did make the mistake. I highly doubt the legal team they have talks with the programmers every day. Most likely it was included by mistake or someone assuming that nobody would say no to them and its inclusion wouldn't make a difference because permission was only a matter of time.
You guys do know this is the same Rockstar that started the whole hot coffee scandal right? They included something in the game that shouldn't have been there. Not the first time, not the last.
However the guy is lucky because the exposure he would have gotten could have boosted his career. Now a good portion of those 20 million will never listen to his music again. Its bad press now and while it will get his name out there, its not going to get him bonus points with the group he wants to be popular with.
