If Bethesda wanted input it's obvious they were open to develope for WiiU, because Nintendo didn't go the route Bethesda wanted, they decided against developing. Bethesda isn't obliged to develope for WiiU, and I doubt they thought they had any clout with Nintendo, they just laid down their requirements, simple as that. Doesn't mean Beth was demanding anything and don't "have a right" to give their opinion.

Bethesda has the right to demand whatever they want, say whatever they please, develop for whom ever they want, hold whatever opinion they want. But when they go on record telling Nintendo what they should have done was to listen more to them they sound like Carly Ray Jepsen telling the Beatles how they should have made music. In other words, they make themselves look ridicolous. Which as you point out, is perfectly within their rights.
