Can't be more then a year cause MS renewed the trademark in september 2012 but then got in legal troubles with Fox over the name.. double helix was working on Battleship till july 2012.. and they said the e3 demo was build in 5 weeks..

i could be wrong but that doesnt mean they only started working on it then   its just the name of the game 

Trademark renewel gives a lot away.. A company like MS would sort that out first before commissioning the order to make a new killer instict.. Its not like they would order to make a new Killer Instinct and 6 months later they deal with the trademark name..
