The law doesn't see it as stealing, but as Copyright Infringement, and as the owner of several copyrights, Nintendo is perfectly entitled to launch a lawsuit against anyone who enables the law to be broken. There is no legal or moral basis to criticise them for it. Those who do are just scared that they will have difficulty getting free games.
