He was a manager of MSFT, and was probably smart (or evil) enough to know that it would keep his ass out of jail if he put a condom on.

Not to mention it sounds premeditated. He could have had the condom on when the janitor came into the office, or slipped it on while she was there. He could have threatened her safety and made her scared to move while putting it on. We weren't there, and we don't have those details yet. This isn't the first case where an alleged rapist was able to apply a condom before the act.
