Contracts. Nintendo doesn't want to favor one distributer over another, and all stores want equal opportunity to compete for customers. There is no way to guarantee all stores get full shipments on the same day, so there is a contractual agreement that no store can sell prior to the release date, so that all stores have a fair shot at the customers. Any store that breaks the street date gets an edge on the competition, and if allowed to get away with it, will harm relations between Nintendo and other retailers. As a result, Nintendo, like many other companies, will jealously guard its release date and may sue any store that breaks this agreement.
