Nintendo are the only ones now. Sony and MS don't have it any more.
Nintendo are also still bad at getting Japanese games to the US, and in any case the original words/sounds are often better (also consider completely inaccurate translation of AWDS by NA, faithful one by EU). By not doing it, you encourage piracy and hacks so legit customers can get the games they wanted and bought running.
Locking on the e-Shop makes no sense at all.
Iwata's explanation here is one of the least convincing things I've ever read. Exactly what limitations is Nintendo under that MS and Sony can ignore?
