There is a such thing as a lie of omission. If they are intentionally giving people the impression that you would be able to play every game for free to your heart's content (and as unrealistic as that sounds, plenty of people do have this impression) when that is not the case, then they are guilty of such a lie.
To assume, even for the sake of argument, that there were no such restrictions is to assume that publishers suddenly decided that they hate money. That is not an idea I'd be willing to entertain without some serious evidence.
