Let's get some perspective. How did the topic come up? Mostly due to MS introduction to certain restrictions for used games. Also Sony will alow 3rd parties to restrict their software if they so desire. So who is pushing for these restrictions? 3rd party developers. Even more specific, western developers.
To them , there are basically two choices. They can either develop for Nintendo or for the HD twins. That is how they divide the market.
Those who decide to develop for Sony and MS are more vulnerable to lose profits by the sale and trade of used games. They are the ones pushing for the restrictions.
Those that decide to develop for Nintendo are partially safe from such loss as the demographics are different.
Nintendo itself is safe because of the demographic that owns the system as well as the replayability of its own games.
But when Nintendo was in the position Sony and MS are in right now (back in the NES/SNES days), then Nintendo did try to put a stop to the game rentals.
