Yeah it would be unfair, but I heard that the used game market in Japan is incredibly huge, which makes this DRM stuff a really big risk in Japan (but I'm not sure about this).

It is also a big risk to use DRM in NA, but since the market is bigger, the risk is probably lower.

Don't know if there are any commerce laws about this specific topic...heck I don't think there are any laws for used games.
