If the X1 goes down you can still use your X1. You just cannot use it for games ;)
Anyway, I just read the official news from MS on the whole DRM issue and it actually not as bad as I thought. The constant Online check is something of a pain which I wonder if they will keep the 24 hour part and every one hour if you are not playing on your main console. Being able to share your game to 10 people in your family sounds great as any person within your family can play on any other device even if its not in their home.
Trading and selling is up to the publishers as most stuff now and there is no fee from MS. The publishers can put a charge and they can decide the fee which will be interesting how the industry go with that one.
