You believe Sony will simply look at Activision, EA, and Ubisoft and tell them no? Sony filed the watermark patenr for a reason and its obvious. In fact Sony themselves have admitted it.  They said pre owned will be up tp the publisher. Same as MS. They also said PS4 wont require online.

Its obvious publishers will have the option of utilizing the watermarked discs and that most will indeed use them

Give me a link that shows an official Sony response stating that PS4 wouldn't implement some sort of DRM? I certainly don't see any. 

Well sony confirmed no internet connection required and gamestop confirmed used games can be traded... How the hell would they possibly enforce it?

I believe what was stated that PS4 doesn't require a constant internet connection. Contant internet connection and no internet connection is a pretty big difference.
