Really depends on your point of view. If we limit this examination to used games only, you are right: Sony's patent is much stricter. That said, I'd say another big factor in why people complain about MS's DRM is because you don't really own the game if you have to connect every day for the game to work. Sony's system doesn't do that: The game works whether you have an internet connection or not. In a way, I'd feel a lot more like I actually owned a game if it used Sony's system instead of MS's system. Not that I'd want either system though, they're both pretty bad.
