If I would have been Nintendo I would have bought 2% of Rare for a total of 51% but I guess Rare said BUY ALL OR BUY NOTHING. Since Nintendo only needed 2 more pecent and not 51 the declined.

That is also the only plausible reason for Nintendo not "owning" Rare now.
