Is there a danger that people are giving the PS4 too much of a free pass?

You are right - there is a lot we still dont know including sony's policy on used games. But going from what they have done with the ps3, any features they have with the ps4 will not be forced or compulsory i.e. if the camera/eye is kinect-like I am sure they will give the option of turning it off and wont force it into most games (or at least make it optional similar to the move functionality). When you look at these things, you go on past behaviour and what sony have done in the past means I am not too worried about what features they will have in the ps4.
