Is there a danger that people are giving the PS4 too much of a free pass?

At the very most the Ps4 could only do what they've done with the Ps3. And by their comments its the most reasonable conclusion to make. Online passes.

Also, why should we assume anything about used games like we should for X1? That's just insanely silly.... We had leaks and news concerning this for the X1 for months and haven't heard a peep about it for the ps4... so again, why should we talk about a non issue?

Worst case scenario.

Sony are terrible at keeping secrets but once in a while, they succeed. what if, this one time they succeed it's the worst news imaginable?

there is no reason to think that though and since thats the case there is no reason to talk about it. No one is giving Sony a free pass concerning it.
