It may or may not be fair use to make a Let's Play using game video. You see, it could count as a reasonable comment/parody of the content. It's never been to court. Personally I'd interpret it as fair use because it's only excerpting the content and commenting upon it.
The problem is YOUTUBE'S COPYRIGHT POLICY. They have an agreement which is nothing to do with the LAW that allows holders like Nintendo to basically do what they want. Youtube do this because they fear getting sued, even though it's probably legal.
BLAME YOUTUBE, not copyright law or Nintendo.
