Well the rumor is obviously true from the a,out of battery drain in old firmwware and still in new firmware in certain games, as well as he fact that these are the only games that don't multitask online while the game is launched.

Kid Icaurs on older firmware has 1 hour less battery life then regular 3DS games, but on Firmware 4.5.0-10 has 30 to 60 minutes longer battery life then regular 3DS games.
Sonic & All Stars Racing Transformed has 1 hour less battery life then regular 3DS games to this current firmware (4.5.0-10) so far.
So these games take up more then an extra 25% of power with firmware higher then 1.0.0-0.
