I agree with this. It reminds me of devs moving from SNES to PSX for similar reasons (oppressive policies). Things like these cause resentment in developers and is a very bad way to go, because we know how that sour feeling is sticking with Nintendo to this day.
It's best to court developers, no matter how small they are. Indie devs may be small time now, but they are making money, and slowly slowly they will become big time as well and challenge the current giants in the industry, breaking the status quo.
It will be a good thing for the industry as a whole, and as such I embrace it.
