I want to know why the handhelds for all the units sold tend to sell way less software then their console brethren per unit , is it piracy or the demographic where you can have more than one handheld in the same house sharing the same games ?

Piracy has traditionally been a big part of it. It's hurt both brands badly. However, with the new genration of handhelds, I think it's important to remember that they probably do a greater percentage of business digitally than the home consoles. I know the Vita does, that's already been confirmed.

Piracy is not an issue with the 3DS, no one has hacked it.
Recently, they have gotten as far as the Friends List, but then it gets bricked on Firmware 1.0.0-0U.
