All the "problems" you listed can be fixed. It is all software related and anything that can be fixed with software updates or manipulation is not really a "problem" in my books. Any modern console can fix software issues or capabilities.
My problem with the wi u are those "problems" that cannot be fix. What my problems are with the wii u is another subject and another thread so I won't expand on that.
Yes, I accept what I define to be "problems" may not quite fit your description.
The three things you listed can all be "fixed" if Nintendo think (as you do) that they are problems. Saying that, I hope that they do consider your point 3 to be a problem.
