Restricted used game use will be huge negative publicity. When it comes to normal media they will latch on any irrelevant aspect and cry doom and gloom. Both MS and Sony should do their best to avoid it.
As far as 3rd party system of choice, their will be no such thing unless MS goes crazy with casual controls and 3rd partys are forced to make PS4 their brad and butter.
