Are people forgetting that most of the games on Wii U are on other systems with much larger user bases, for cheaper prices? AC3, ME3, Batman and so forth. id bet my bottom dollar that must be a factor if not a large one.

This.

Now for me personally because I am coming late to the HD game, the Wii U launch was freakin huge for me as a gamer.  I now have my hands on Arkham City, ME3, Darksiders2, Blops2 for the first time...all during the launch week.  AC3 still to come.  That is just huge for someone like myself to have access to those types of games in a launch timeframe.  For everyone that was already at the HD party, the Wii U luanch has much less significance.  Minus the gamepad, which to me is bar none the best way to play games (if done properly).

So, yeah.  Software sales are not going to blow the doors off.  Wii U needs new quality platform specific games, or to release alongside the other HD versions, but with viable reasons through improved graphics, platform specific extra content and excellent gamepad implementation to get people to A. buy a Wii U and/or to buy the Wii U version of those games.
