I am not convinced that Nintendo is required by (national or European) law to apply this to all EU countries. I've got the feeling that Nintendo is not bothered by this too much (Nintendo never reall liked adult-only stuff, right?) and chose the simpler version of applying it to all of Europe.

It should be quite easy to restrict this to Germany and/or to create workarounds like other people in this thread have suggested (age verification).

By the way I find it quite ignorant of people in this thread who post generalized, biased comments like "German laws suck" based on this one instance where it might actually just be Nintendos way of interpreting this law.

They are required just as all other German online retail shops are required.  This isn't exclusive to Nintendo.

As for content, keep in mind that it was Nintnedo of Europe that bundled the USK 18 rated ZombiU with the 32 GB Wii U model.   And Nintendo published the ultra violent Ninja Gaiden 3: Razor's Edge and have funded and will publish the hyper erotic and violent Bayonetta 2.  While they may have shied away from it in the past, they seem to be embracing it much more now than ever.

And I agree that saying all German laws suck just becaue this one is overly cautious is rude.  However, it's not Nintendo's interpretation but rather the actual regulation itself that's in place.
